Rahul Gandhi Defamation Case Supreme Court Hear Plea To Suspend Conviction Over Modi Surname Case

Rahul Gandhi Defamation Case: The Supreme Court will hear on Friday (July 21) the petition of Congress chief Rahul Gandhi within the defamation case associated to the Modi surname. Justice BR Gavai and Prashant Kumar Mishra can be within the listening to bench.

Based on LiveLaw, Rahul Gandhi has challenged the choice of the Gujarat Excessive Court which rejected his plea looking for a keep on the conviction (two years’ imprisonment).

What was the request made by Rahul Gandhi’s lawyer?
Senior advocate Abhishek Manu Singhvi, who appeared for Rahul Gandhi final time, requested the petition to be listed on July 21 or July 24. After this, a bench of Chief Justice DY Chandrachud, Justice PS Narasimha and Justice Manoj Mishra agreed to listen to the petition. The bench had mentioned that it will hear the matter on July 21.

What did Rahul Gandhi argue?
Rahul Gandhi has mentioned in his petition filed within the Supreme Court on July 15 that if the order just isn’t stayed, it should suffocate free speech, free expression, free thought and free assertion.

He mentioned in his petition that if the Excessive Court judgment just isn’t stayed, it should systematically, repeatedly undermine democratic establishments and end in suffocation of democracy, which can be critically detrimental to India’s political local weather and future.

What’s the matter?
On April 13, 2019, throughout an election rally in Kolar, Karnataka, Rahul Gandhi remarked that why all thieves have the identical surname Modi? Purnesh Modi, a former Gujarat authorities minister and BJP chief, had filed a legal defamation case towards him for this remark.

On this case, on March 23, the Metropolitan Justice of the Peace Court of Surat convicted Rahul Gandhi below sections 499 and 500 (legal defamation) of the Indian Penal Code (IPC) and sentenced him to 2 years in jail.

After the decision within the case, Rahul Gandhi was disqualified from the membership of Parliament. Rahul Gandhi was elected to the Lok Sabha in 2019 from Wayanad in Kerala.
